Haftung

In one sentence

Haftung is legal responsibility for damage caused. Offering blood collection is a new activity for most pharmacies, so it is worth checking how it sits with existing insurance cover and what documentation would actually be available if a claim arose.

Haftung is the question of who answers for damage. It comes up early in every conversation about pharmacy blood collection, and it deserves a factual answer rather than reassurance.

The starting point is that the pharmacy carrying out the venöse Blutentnahme is responsible for it. That is not unusual. Pharmacies already vaccinate, advise on medication and prepare individual formulations, all of which carry responsibility.

Three things change the practical picture, and all three are within a pharmacy's control.

The first is cover. A Berufshaftpflichtversicherung written before a pharmacy offered blood collection may not describe the activity. Asking the insurer to confirm in writing that venous blood collection and the associated advice are included, rather than assuming it, is the single most useful step before the first appointment.

The second is documentation. If a question arises months later, what exists is what was written down: the Aufklärung und Einwilligung, who carried out the draw, that they held a confirmed ärztliche Schulung, which materials were used, and what was said about the result. Following the Standardarbeitsanweisungen and recording that they were followed is the practical defence.

The third is staying inside the role. A pharmacy collects values and puts them in context. Interpreting them, naming a condition or advising on treatment is medical judgement, and stepping into it is where responsibility grows fastest. Saying plainly that a value is not a diagnosis and routing anything unclear to a physician is a boundary as much as a courtesy.
